A US judge has ruled that Burger King will have to confront a lawsuit claiming that its Whopper burger is presented as larger on its menus than its actual size. The lawsuit asserts that the fast food chain deceives customers by showcasing the burger with a more substantial patty and ingredients that spill over the bun. Burger King responded to the allegations by stating, "The claims made by the plaintiffs are not accurate." Similar litigation is being faced by McDonald's and Wendy's in the US. The collective lawsuit aimed at Burger King alleges that the Whopper is visually inflated by 35%, appearing to contain more than twice the quantity of meat compared to what is genuinely served to customers. Initially, Burger King argued that it wasn't obliged to provide burgers that perfectly matched the promotional imagery. In the ruling, US District Judge Roy Altman asserted that determining what constitutes a reasonable perspective should be entrusted to jurors. Nonetheless, the claims that Burger King misled customers through its TV and online advertising were dismissed by the judge. A Burger King spokesperson reacted to the decision by affirming that the flame-grilled beef patties portrayed in their ads are the very ones used in the millions of Whopper sandwiches served nationwide. The Whopper, described on the Burger King website as "The ultimate burger," features a "genuine meaty" beef patty along with other components. In recent times, various fast-food chains have encountered legal disputes concerning allegations of false advertising. Earlier this year, Taco Bell faced a lawsuit in the US for purportedly selling pizzas and wraps containing only half the filling advertised. In the preceding year, a New York resident proposed a class-action lawsuit against McDonald's and Wendy's, asserting that the companies engaged in unjust and deceptive trade practices by featuring burgers in marketing materials that were at least 15% larger than the actual products. |
